“ELIGIBLE FOR SICK LEAVE”

|
To break the chain of epidemic Covid 19, many UAE employers
call employees to be quarantined in home for short time periods preventing
from work. Such employees are entitled for payments of ‘Sick Leaves’ under
the Federal Law No.8 of 1980, generally called as ‘Labour Law’.
Article 82 of Labour Law provides that if the employee
falls sick, he must report his illness within a period of two days at most. The
employer is obliged to take necessary steps to ascertain employee’s illness.
He can demand employee to be quarantined for certain number of days to
prevent uncontrolled dissemination of the illness. Due to the apprehension of
spreading Covid 19, it is recommended to stay at home avoiding continuation
of the chain.

Employees who work from home based on the instructions of
the Employer shall be eligible for full benefit provided by Employer.
Employee who has completed probation and three months is
entitled for sick leave of not more than 90 days either continuous or
intermittent per each year or service.
Benefits of such employees shall be calculated as follows:
a)
Full pay for the first fifteen days
b)
Half
pay for the next thirty days
c)
Without pay for the subsequent period.
Important: The Government yet to announce notification
regarding quarantine of employees due to COVID,19. Above given is purely based
on UAE Laws.

UAE Labour Laws
Eligible
employees who has been quarantined by the demand of the employer shall be
entitled for the full benefit in first 15 days. Half pay for the next thirty
days and without pay for the rest. Special notification upon the context of
COVID 19 yet to be announced.
